Missing Phone Leads to Skatepark Brawl

Teen arrested after striking man thought to have taken cell phone.

 

A 19-year-old Winder teen was arrested on a charge of disorderly conduct after allegedly striking a man during a Dec. 8 altercation at Duncan Creek skatepark.

Police were called to the Chevron on Braselton Highway at Jim Moore Road after a 20-year-old Hoschton man said he was assaulted at the skatepark over a missing cell phone. According to the victim, he was visiting the skatepark when a teen, later identified as Jacob Bergen of 105 New Cut Road in Winder, approached him. Bergen reportedly accused the victim of stealing his cell phone. The victim denied having the phone and said he offered to let Bergen and his friends search him. The victim also told the officer he offered to buy Bergen another phone.

Bergen allegedly became upset and struck the victim in the head. The victim said he and Bergen briefly fought. The victim admitted striking Bergen before leaving the park and going to the Chevron. The victim had swelling and redness above his left eye and grass on his back.

Police located Bergen at the skatepark. According to Bergen, he believed the victim stole the phone because the victim left the area when the phone went missing. Bergen said he asked the victim if he took the phone and the victim replied, “The black one? No.” Bergen admitted throwing the first punch.

Based on Bergen’s admission and the victim’s injuries, the officer charged Bergen with disorderly conduct. The officer also filed a report regarding Bergen’s missing cell phone.
