Sheldon: H.B. 87 Profoundly Changes How State Addresses Illegal Immigration
State Representative Donna Sheldon (R-Dacula) describes legislation as "one of the most impactful pieces of legislation in our lifetime."
Dacula Patch asked State Rep. Donna Sheldon for her thoughts regarding the passage of H.B. 87 in the Georgia House of Representatives. Here is her response in its entirety:
On March 3, 2011, the Georgia House of Representatives passed one of the most impactful pieces of legislation in our lifetime. H.B. 87, the Illegal Immigration Reform Act, profoundly changes how our state addresses the issue of illegal immigration. Sadly, there has been much misinformation presented about H.B. 87 from various outlets. It has also been the victim of several unfair comparisons to other states legislation, particularly the Arizona immigration bill.
I wanted to take a few moments to outline the bigger details of H.B. 87 which has successfully passed the House and is now in the Senate. While many may still oppose it after this review, I believe it is necessary to understand a bill’s true intent and components before real debate can begin. I hope you fill find these details hopeful and please feel free to contact me with any questions you may have.
The Issue of Illegal Immigration and its Impact:
It is one of the fundamental responsibilities of the federal government to protect the border. However, most would say the federal government has failed to do so. Sadly though, it is state and local communities and taxpayers that must deal with the heavy financial and social burden of illegal immigrants. Georgia’s unemployment rate is at historic levels and it is our job as state legislators to protect job opportunities for Georgia’s legal citizens. As a state government, we cannot and do not have the authority to enforce the border of our country. However we cannot afford to wait idly for the federal government to act. Our local and state budgets have become smaller and smaller so greater scrutiny must be given to those who receive services from those budgets.
The fiscal burdens created by illegal immigrants directly impact the cornerstone services Georgia provides its citizens and the level at which they are provided, the Federation for American Immigration Reform estimate that burden to be $2.4 Billion per year. The services illegal immigration impacts include education, healthcare and law enforcements/correction.
Here are some quick facts concerning the state of illegal immigration in Georgia:
- The Pew Hispanic Center recently determined that Georgia’s immigration population ranks seventh in the nation
- That same study estimates an illegal immigration population that nears 425,000, or a city population second only to Atlanta
- From 2000-2009 Georgia’s illegal population grew by 115 percent, the fastest of any state
As one can see, legislation was necessary to address Georgia’s serious social and economical problems caused by the federal government’s failure to secure our border.
H.B. 87: A Good Step in Illegal Immigration Reform
H.B. 87 attempts to address these issues and remove incentives for illegal immigrants for settling in Georgia. It essentially has four main points which are the expansion and implementation of the federal E-VERIFY system, identification document verification, law enforcement incentives for dealing with illegal immigration and tools to combat this problem. These points are expanded upon below:
1.) Expands the use of federal E-VERIFY system
- The E-VERIFY system is an accurate, no-cost, internet –based federal database designed to verify the eligibility to legally work in the United States. It is only intended for newly hired employees. It is NOT a screening system. More than 16,000 Georgia businesses already use E-VERIFY.
- Require the use of secure and verifiable identification documents for any official use, including the dispensation of public benefits
- Provide greater incentives for law enforcement agencies to participate in federal partnerships that will provide faster and more efficient identification and transfer of illegal aliens
- Provides new tools for law enforcement to allow greater latitude in handling immigration issues
2.) Provides for greater opportunities to prosecute those that knowingly harbor or transport illegal aliens in our state, or that knowingly entice entrance of illegal aliens into our state
3.) Provides greater opportunity for law enforcement officers to identify illegal aliens during the course of an investigation
4.) Provides penalties for government officials who fail to enforce state laws related to immigration

As we watch the values of our homes decline and the costs of everyday living rise, I am sick to death of people who come here illegally and leach our education, health care and safety and security personnel at taxpayers expense. Illegals pay no taxes as they have no Social Security Number (except a fabricated one) and yet they send their multitude of children to our public schools, use our hospital emergency rooms as their personal physicians and are constantly involved in drugs and violence, causing untold harm to our legal citizens.
I have a daughter that was adopted outside of this country legally and I can assure you that it involves a huge process of government red tape and fees to be admitted legally to this country and gain legal citizenship. Just running across the border should give you no rights to partake of our social and economic welfare nets meant to support our citizens in their time of need.
We need to find these people using every illegal means possible to bleed us dry and prey on our citizens and send them back across our borders. They would be welcomed IF they followed the process to become legal, productive and contributing members of our communities, but they are not and they need to go.
I applaud this legislation and will write my legislative representative to encourage its passage and implementation. It will not be too soon for Georgia to wake up and take care of Georgians for a change and not every illegal here with his or her hand out.

Generaliztions should not affect all illegal immigrants. There are illegal immigrants who pay taxes with a Tax Indetification number, which in a way serves as an I.D. to pay for taxes, without receiving the federal aid given to those who have a social security number such as retirement money and disability aid. Many of thee illegal immigrants come here for an opportunity, and many work from from sun up to sun down performing arduous jobs like construction, carpet installation, roofing, and yard work. It is because they lack education that they have to resort to these jobs. No one with at least a high school dploma will be willing to climb a 5 floor bulilding in sun with only slim, thin pieces of wood as support.
If immigrants come to this country, it is because they do not have money and want a better life. Do you think they will be able to afford all government fees, some do not even qualify. Under the foreign policy, in other to even get a tourists visa to the U.S, immigrants have to have ownership of a property in their native country. If anybody had property, than why would they leave?Most misconduct especially among young people is not caused by illegal immigrants, but by their children. Kids who grow up facing racism, unequality, discontent, and above all rejection. This hatred causes the social problems. They are teens who were born here and under the constitution are citizens, so any bill targeting illegals to promote social security is aiming at the wrong group.

Mary, I believe that if you're in the country illegally, your illegal, plain and simple. It doesn't matter what job you do, what color of your skin, how old you are, or anything else. Call me old fashioned, but I think you need to enter this country according to the laws we have in place to handle that.

I think this bill is a step in the right direction, I doubt that the above poster has had to compete with contractors that hire illegals. My concern is will this ever be enforced.

The United States has a department that watches the birth and death rates, the job indicators,the government status of many different agencies & then determines the number of LEGAL immigrates to let enter the country each year. If you don't keep a watchful eye on the numbers, the economy goes out of control.HUGE unemployment, over crowded schools, high crime rates& so on. Soon a party will court the illegals for their votes by offering a blind eye. We are there. At what point does our leader face the truth?

why is it that no one complained about illegals when tyson foods was smuggling them into cumming, georgia during the 90s? and y'all eat tyson, don't you? don't believe me. do a little search. of course, they denied that they had knowledge of it. just like reagan denied knowledge of the contras. things will start to get interesting, if they haven't already. i've met some illegals that were from poland and russia, but no one complained about them because they were fair-skinned and blond.

but i bet you didn't have a problem that the industrial base was dismantled & sent to china or that the tech jobs went to india or that the bailout made a lot of bankers richer. truthfully, if it weren't for the fact that so many people came here illegally, i wouldn't have job. period. i'm not for illegal immigration . . . i am for getting people legalized. bill or no bill, i will not change the way i live. i will not ask people for their papers before they get in my car or enter my home.

We are all inmigrants did someone asked Christopher Columbus for his green card?! I dont think so!! Yes there is hispanics asking for food stamps or wic but guess what there are paying taxes not like other "American Citizens" that get in debt and go bankrupcy and on top of that live on government houses how come no one is talking about them? All we hispanics do is come work and look for a better future for our families. I do think this bill is a Hate Bill i wonder what happend with ......And Justice For All?! But guess what just like it says in the Bible If God is with us, then who can be against us? Maybe this sounds like a good thing for some people but Our God has a better plan for us the hard working people! Take away the comments about skin color and loosing jobs and what do you have? A person who believes he or she is above the law, plain and simple! We are a country of laws. We are a country built on voting. We are a country with legal ways to enter this great nation. Our nation has been invaded. Our nation is bearing the cost of illegals. Our nation must stop this downward spiral of its government. Just like a child who wants his way even when he is wrong, are those who think because THEY WANT TO BE HERE, they should be here! The parents must teach the child that they are wrong. The parent in this case , the federal government, WILL NOT PUNISH THIS BAD CHILD! A person close to the situation, ie- our state leaders, will enact laws to insure our citizens will not be harmed by the BAD CHILD who wants what he wants- our medical care, our seats in the classrooms, our jobs that we have been doing since our country was born, (I wince when their argument is, " WE ARE TAKING THE JOBS NOBODY WANTS OR WILL DO! (as far as I know there were landscapers and hotel workers before the borders fell!) The question is WHY will our federal leaders not address the problem? ANSWER- Because their jobs depend on the votes of the illegals! Plain and simple! While millions of LEGAL Americans DO NOT VOTE Millions of ILLEGAL do vote and so politicians know where there bread is buttered and will not bite the hand that is feeding them-the illegal voters! Now you know why our US is failing!

hi every one happy fathers day .... well i am an american citizen married 11 years ago have a wonderful family of 5 but i dont know what is going to happen to me and my children after all this hb87 my husband is a wonderful hard working man great husband and father he works 14 hours a day for 80 dollars has been abused in lots of ways by employers been called wet back and negro just for being dark skin has fallen from a roof at a job injured a leg and never did anything against his employer never has had legal problems with no one helps me do my laundry and clean the house when he does not work i just dont know what else to tell you we live in a very small apartment he pays our rent and bills we survive as we can but after all this going on does it mean i am going to have to leave the country and i am going to be the ilegal at his country?? he has been approved by the inmigration dept but we are still waiting for the reform does this law protect people who have a legal process with inmigration?? i just think about my kids i dont want them to go through a trauma emotionally as well as my self we are family who love each other and dont know how to be one away from the other anyone has an answer for me???i could care less if they kick out the bad apples that come and destroy my country but not the people that deserve to stay that has a family that love and protect him

THIS IS ALL ABOUT MONEY!!! The illegal immigrants are the ones being abused by crooked business people that hire them for below-market wages, work them long hours, don't pay taxes on them, etc., etc. And we do not need a fence on the border. We need our current laws enforced. I can tell you that if a business was fined $100K per illegal employee, their benefit from hiring illegals would go away. And without jobs, the illegals would go back to wherever they came from. As for the rest of us, we'd better get used to paying more for landscaping, construction and maybe no more "free" chips and salsa at Mexican restaurants....

This country was build on the labor and lives of its citizens. Lives were lost for the betterment of our great country. We are a country of laws. When laws fall by the way side we become lawless and begin to spiral out of control. We are now seeing the affects of a portion of our people, non citizens having a major impact on our country economy. We continue to free fall into record unemployment, housing crumbling food cost out of control, college students with no jobs to begin, and a healthcare system that is broken so WE JUST ADD ANOTHER ONE ON to the BILL!! YOU CAN NOT add billions of illegal workers into our country without expecting a negative impact on our country. WHie we all know many illegals and now that a face has been put on this major problem our country faces, we either must decide to give in to law breakers (even if we know them in person0 or to follow the laws of the land. Our great country is depending on law abiding citizens to bring up out of this time oa trials. So stand firm and do the right thing for your grandchildren and children's very future depends on it

When a crime has been committed , a criminal has their life changed forever. They must make their "title" of criminal pubic notice to anyone they may approach for a job. Job applications have specific entries for a person, whom is a known criminal, to report their past. Many times, due to their past criminal behavior, they can't be hired or will not be hired. Let's face it if there are 60 people looking for a job, a convicted person is the last person an employer may want to hire. Illegals have broken our laws. "IT IS WHAT IT IS!" If you are here illegal, & have half a brain, you KNEW what you were doing was wrong & that someday the JIG would be UP! That day has arrived. Why act like a poor harmed victim? You knew when you came here you were wrong. Now you want the citizens of this country to say, " HEY give them a PASS!" If you follow that mentality we should OPEN THE JAIL DOORS & GIVE EVERYONE A PASS! This country allows for LEGAL entry into this country, get in line! DO not ask those whom you are harming for a pass because you got caught! Truth is a HARD TASK MASTER! YOU got caught. You came for a job, this state is making getting a job here no longer an option. So you're saying kick out citizens that break the law but allow illegals to stay... when they've ALREADY broken the law? You can't have it both ways.

i am a us citizen and i also think i should have priority? i am married i love my husband we have a wondrful family we have 3 very small children and my husband is a hard working responsible person great father and human being we have a legal process pending for years and years and now we must split our family because of all this ? he needs to move out of usa for who knows how long? how do you think i feel? what do you think this is going to do to my kids? they love daddy and is all that they know i dont want to move to his country with my children i love america this is my home this is my kids home and this is where i wish to stay should not people like my husband deserve to stay?....should not citizens have priorities? or are they going to make a law that make you be married only to americans? what ever happened with the freedom to love i love my husband dearly and i am praying that all this stops for my family and other families that dont speak up thanks and god bless you

My point is that it appears you and your husband are doing the right things and taking the correct steps, I have no problem with that. It's those that come here without going through those steps that are breaking our laws.

but my concern is where on the hb85 says that people that have a legal case pending are protected?? where does it say that families will not be affected because of this?? does it say that i wont be cited for having my own husband in my car?? there is employers out there taking advantage of people that are ilegal here they are underpaid over worked no insurance no coverage of any type also people that are ilegal do have what they call an itin and some do taxes and pay their taxes because they have hope that one day they will have an opportunity to be legal and keep a good moral i dont understand why people say that they come to the usa to get money and foodstamps and wic and all that is false if you are ilegal you get nothing only us residents and us citizens qualify i guess you would have to give your self the opportunity of knowing them talking to them to realize that some people are good and are no harm to the country this is why they call us racist because we are generalizing everyone and that is wrong we should respect to be respected if you open the door you will get a thank you kindness and love is what moves our world around i also feel so sorry for all those people that are dead trying to cross the border they were trying to reach a dream and that dream could of been help their families coming here to work please every one wake up and realize that the hb5 needs to be corrected before is approved

very true, but the indoctrinated masses will argue according to the programming. the spanish took over the New World and enslaved/massacred/displaced the people living on the continent. Then the Portuguese came and there was battling over lands and people. The French came, the British came . . . wars were fought. New lines were drawn. The ruling elite put their expendable pawns to fight their wars of dominion and then instill the powerless masses with patriotic fervor. There's not much to argue since the story doesn't seem to change much. While the ruling elite rob their "own people," they get them worked up in "illegals" crossing borders to "steal" work and women. It's all so laughable.
