Arrestee: 'I Had One Drink Today ... Maybe One and a Half'

Woman, who was apprehended in possession of an alcoholic beverage, said she thought criminal trespass warning only applied to panhandling at Walmart, not shopping.

A Buford woman's failure to understand the meaning of a criminal trespass warning landed her in jail on Nov. 16.

Gwinnett County Police were called to the Hamilton Mill Walmart after a store employee spotted Michelle Levos, 53, on the premises. Levos, the employee explained, was not supposed to be on the property due to the fact she had been given a criminal trespass warning. 

The officer spotted Levos leaving the store. When asked for her driver's license, Levos -- who was carrying bags containing alcoholic beverages and cigarettes -- handed over her Gwinnett County Department of Corrections identification card and a United States Post Office identification card.

The Walmart employee presented the officer with a copy of the criminal trespass warning that had been issued to Levos on Oct. 30 along with still images showing Levos on the property after that date.

"Levos said she thought the criminal trespass form was just for her panhandling in the parking lot and not actually shopping in the store," the officer wrote in the report.

The officer noticed Levos was carrying a QT cup. The cup, Levos reportedly admitted, contained alcohol, but she told the officer she had not been drinking out of it.

Levos was placed under arrest for criminal trespass and disorderly conduct. While in the back of the patrol car, Levos allegedly said, "I had one drink today ... maybe one and a half."

Levos was transported to the jail without incident. The officer obtained a warrant against Levos for criminal trespass and issued a citation for disorderly conduct. The officer also took possession of Levos' postal service identification due to the fact she no longer works for the post office and the card stated the badge was to be surrendered upon leaving the employ of the postal service.

Levos was released three days later on a $1,435 bond.
