Dacula Brothers Injured, Arrested as Result of Drunken Melee

Nephew said everything was fine until brothers "had their 9 o'clock shot."

Two Dacula brothers landed in jail after a drunken fight left both men bloodied and battered.

On Jan. 21, police responded to the Majestic Circle home of David Montgomery, 42, and Jeffery Montgomery, 39, after another resident of the home called 911 to report the two brothers were engaged in a physical altercation.

When police arrived, Jeffery Montgomery opened the door and reportedly stumbled outside and fell to his knees on the front porch. The officer escorted Jeffery back inside the home and subsequently located David Montgomery in a bathroom washing blood off his face and ear.

When asked what happened, Jeffery told police that he and David were “drinking, laughing and having a good time” when David took a swing at him and missed after getting his feelings hurt. Jeffery said this made him angry. According to the police report, Jeffery explained that he “tried to calm down, but the rage built inside him” causing him to pick David up and slam him on the floor. Jeffery then began to walk away, but David came after him.

David claimed the fight started after Jeffery called David’s girlfriend a “whore.” David told police he retaliated by telling Jeffery that their father loved David best. David admitted swinging at Jeffery and missing and said a struggle ensued.

A nephew of the two men witnessed the arguing and fighting. According to the nephew, the two men had just “had their 9 o’clock shot” when David got upset and tried to hit Jeffery. The nephew, who had also been drinking, attempted to stop the fight but was injured in the process. The nephew refused medical treatment despite advising that his leg had been dislocated three different times during the struggle.

Another witness to the incident, the person who called 911, said she was in one of the bedrooms when she heard fighting. She walked into the living room and saw David take a swing at Jeffery. At that point, Jeffery reportedly told her to go back to the bedroom. The witness said she did so and called police.

The reporting officer noted that 27 photos were taken of the brothers’ injuries and damage throughout the home. David was later taken to Gwinnett Medical Center for treatment of a lacerated ear. His hand and elbow were x-rayed, a CT scan performed and his thumb splinted before he was transported to the Gwinnett County Jail. Jeffery was assessed at the jail.

David was charged with battery and criminal trespass, Jeffery was charged with battery. Both men were released on bond on Jan. 22.
