Shoeless Man Charged with Meth Possession in Dacula Neighborhood

Police say there was also an outstanding warrant for the 35 year old.

After answering a call of a report of a suspicious person Sunday morning, July 21, Gwinnett County Police ended up arresting a Dacula man on an outstanding warrant and for a violation of the Georgia Controlled Substances Act.

Officers found the 35 year old in a driveway in the 2500 block of Millwater Crossing wearing shorts, a shirt and socks but no shoes, according to an incident report.  He was reportedly sitting in front of a gift bag that was partially covered with a towel.

The man, who resides at a different address on the same street, told officers that he was waiting on a friend.

"For our safety, I asked (the man) if I could look in the bag and he said 'yes,'" an officer wrote in the report. "I grabbed the bag and made a quick inventory of the contents.  There was nothing in the bag that appeared to be a danger to myself or my back up [sic] officer so I placed it back on the ground where it was."

Police had dispatch check the man's name, Quocphong Duy Pham, and date of birth and learned that there was an active warrant for his arrest. 

Once handcuffed, officers say they searched Pham and found in his pocket "a  clear baggy with a crystal substance inside."

The officer asked Pham if there were any more methamphatamines on him and Pham allegedly replied, "No, it's in the bag."

Upon checking the gift bag a second time, police say they found a second small  bag inside that contained a clear liquid.

"Mr. Pham stated freely and voluntarily from the back seat, 'I added water to it, so I couldn't use it,'" the officer wrote in the report.

A field test of both substances returned a presumably positive result for amphetamines, police noted.

Pham was booked on charges of probation violation and a violation of the Georgia Controlled Substances Act. He was released on July 24 after posting a $5,700 bond, according to jail records.  An arrest isn't a conviction.
