Warrants Issued for Three Dacula Men in Connection With Rape, Battery of 18-Year-Old

Two other men have also been arrested.

Gwinnett County Police have obtained warrants for five men in connection with an alleged rape and battery at a Buford apartment complex. Three of the five men have been arrested, two others are still being sought.

The warrants, obtained on Nov. 26, are the result of an investigation into an October incident at The Preserve at Ivy Creek apartment complex on Mall of Georgia Boulevard.

On Oct. 14, police were dispatched to Gwinnett Medical Center after an 18-year-old woman was brought into the emergency room for treatment.

The woman said she had been out celebrating her birthday with friends and ended up at an apartment in The Preserve at Ivy Creek complex. The woman explained that she had been drinking and subsequently spent the night at the apartment. The next morning, the woman awoke around 9:30 a.m. and began drinking again.

"The victim advised that after drinking for an unknown period of time, she blacked out," the officer noted in the report. She was later awakened by two females and told she needed to leave the residence.

The female went home and fell asleep. Several hours later, she felt pain and noticed she was bleeding. According to the report, she also noticed bruising on her thighs.

The woman's brother took her to the emergency room to be assessed. The woman advised she does not remember being raped, but was told by a friend what had happened. The woman said she did not wish to prosecute, but was informed a report would be completed regardless.

The case was assigned to an investigator. In a report dated Nov. 27, the investigator wrote, "During the course of my investigation, I determined there was probable cause to charge the listed suspects with the listed charges." The investigator obtained warrants on Nov. 26 against five men for rape and aggravated battery.

On Nov. 27, three of the five men were taken into custody:

  • Adam Gibson, 22, of Lawrenceville
  • Daniel Marmolejo, 22, of Flowery Branch
  • Tyler Whitehead, 21, of Dacula
As of Dec. 3, all three remain jailed without bond.
